These Terms of Service ("Terms") are an agreement between you and Kashout ("Kashout," "we," "us"), a sole proprietorship based in California. By creating an account or using the site, you agree to these Terms. If you do not agree, do not use Kashout.
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. By using Kashout you confirm that you meet these requirements.
Kashout is a sports and crypto analytics and statistics tool. It lets you build stat-based "signals," shows how often those patterns have historically occurred (backtests), and surfaces live in-the-moment readings. It is a data product, not a sportsbook, broker, or exchange, and it does not accept, place, or process any wager or trade.
Kashout is for informational and entertainment purposes only. It is not betting advice, financial advice, investment advice, or a prediction or guarantee of any outcome. Hit rates and other figures are historical counts, and past performance never guarantees future results. Nothing on Kashout is a recommendation to place any bet or make any trade. You are solely responsible for every decision you make.
Sports wagering and crypto trading involve real risk of loss and are regulated or restricted in many places. You are responsible for knowing and complying with all laws that apply to you, including gambling and age laws. Do not use Kashout where it is prohibited. You use any information from Kashout entirely at your own risk.
Provide accurate information, keep your password secure, and do not share your account. You are responsible for activity under your account. We may suspend or terminate accounts that break these Terms or abuse the service.
If you are locked out: we do not send password-reset emails. Open a ticket in our Discord and we will verify that the account is yours before issuing a one-time reset link. For paid accounts that means confirming billing details we can check against our payment processor. Because recovery is manual, keep your password somewhere safe.
You agree not to: scrape, crawl, or bulk-download the service; reverse-engineer or copy it; resell or redistribute access or data; interfere with or overload the service; or use it for any unlawful, abusive, or fraudulent purpose.
You own the posts, captions, and other content you create ("Your Content"). You grant Kashout a non-exclusive, worldwide, royalty-free license to host, store, reproduce, reformat for display, and display Your Content in order to operate and promote the service, including in our own community channels. You are responsible for Your Content, and we may remove content that breaks these Terms. If you believe content here infringes your copyright, contact us and we will review and remove it where appropriate.
Kashout, including the site, brand, design, and underlying data and models, is owned by us and protected by law. These Terms do not give you any rights in it beyond using the service as intended.
Kashout relies on third parties: Stripe (payments and the billing portal), Railway (hosting), Discord (our community and support channel), sports and market data providers, and an IP-geolocation lookup. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies. If you contact us through Discord, your use of Discord is subject to Discord's terms.
Kashout is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of accuracy, fitness for a particular purpose, or non-infringement. Data, models, and live feeds may be delayed, incomplete, or wrong. We do not warrant that the service will be uninterrupted or error-free.
To the fullest extent permitted by law, Kashout is not liable for any betting, trading, or gambling losses, lost profits, lost winnings, or any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so parts of this may not apply to you.
You agree to indemnify and hold Kashout harmless from claims, damages, and expenses arising out of your use of the service, Your Content, or your breach of these Terms.
You may stop using Kashout at any time. We may suspend or end your access if you break these Terms or if we stop offering the service. Sections that by their nature should survive (for example, disclaimers, limitation of liability, and indemnification) survive termination.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing any claim, you agree to first contact us and try to resolve it informally.
If any part of these Terms is found unenforceable, the rest stays in force. Any claim must be brought within one year of when it arose. These Terms are the entire agreement between you and Kashout about the service, and replace any earlier drafts or understandings.
